Terms of Service

1. Acceptance of Terms

By accessing or using cmail (the “Service”), operated by Sensfix Inc. (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, do not use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Service Description

cmail is an AI-powered email co-pilot that classifies incoming emails, generates draft replies in your organization’s voice, and tracks email conversations through pipeline stages. The Service operates by connecting to your email provider (Microsoft 365, Gmail, or IMAP) with your explicit authorization.

AI-generated drafts are suggestions only. You retain full control over what is sent from your email accounts. cmail does not send emails automatically without user review and approval.

3. User Accounts

To use the Service, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Organization administrators are responsible for managing team members, email connections, and configuration settings within their organization. Administrators must ensure they have proper authorization to connect team members’ email accounts to the Service.

You must notify us immediately of any unauthorized use of your account at support@getcmail.com.

4. Acceptable Use

You agree not to use the Service to:

  • Send spam, unsolicited bulk emails, or phishing messages
  • Generate content that is illegal, harmful, threatening, abusive, or harassing
  • Impersonate any person or entity, or misrepresent your affiliation
  • Attempt to gain unauthorized access to other users’ accounts or data
  • Reverse engineer, decompile, or disassemble the Service or its AI models
  • Use the Service to train competing AI models or services
  • Exceed rate limits or attempt to circumvent usage restrictions
  • Violate any applicable laws, regulations, or third-party rights

We reserve the right to suspend or terminate accounts that violate these acceptable use policies without prior notice.

5. Payment Terms

The Service offers a Free plan and a paid Pro plan. The Free plan includes limited features as described on our pricing page. The Pro plan is billed monthly or annually through Stripe, our payment processor.

Pro subscriptions auto-renew at the end of each billing period unless canceled. You may cancel at any time from your admin dashboard. Cancellations take effect at the end of the current billing period. No partial refunds are provided for the remaining portion of a billing cycle.

We reserve the right to change pricing with 30 days’ notice. Existing subscribers will be notified by email before any price changes affect their subscription.

6. Intellectual Property

The Service, including its software, design, logos, AI models, and documentation, is owned by Sensfix Inc. and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

You retain ownership of your email content, organization data, and any content you input into the Service. AI-generated drafts produced by the Service for your use are owned by you once generated.

You grant us a limited license to process your email content solely for the purpose of providing the Service (classification, draft generation, and pipeline tracking).

7. Limitation of Liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

AI-generated email drafts are machine-generated suggestions. We are not responsible for the content, accuracy, or consequences of emails you choose to send based on AI-generated drafts. You are solely responsible for reviewing and approving all email communications sent from your accounts.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SENSFIX INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

8. Termination

You may terminate your account at any time by deleting your organization from the admin dashboard or by contacting support. We may suspend or terminate your account if you violate these Terms, fail to pay subscription fees, or if required by law.

Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days to allow for account recovery, after which all data will be permanently deleted, except where retention is required by law.

9. Changes to Terms

We may modify these Terms at any time by posting the revised version on our website. Material changes will be communicated via email to account administrators at least 15 days before they take effect. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Delaware.
